Terms of Sale

The current General Conditions of Sale regulate the website www.funidelia.co.uk, of which FUNIGLOBAL DEVELOPMENT S.L. is the owner.

These conditions establish the rights and obligations of all users of FUNIDELIA, regarding the products and services provided through our website “www.funidelia.co.uk”.

These conditions are just as important to us as they are to you, as they have been designed to create a legally binding agreement between us, protecting the rights of the customer as well as those of the company.

We recommend that you read the current conditions of our Privacy Policy.

By using our website “www.funidelia.co.uk” or by making an order, you are knowingly bound by these Condition and by our Privacy Policy. If you do not agree with all of the Conditions or our Privacy Policy, you should not make an order.

These Conditions are subject to change and so should be read each time you make an order.

By making an order on “www.funidelia.co.uk”, you are in full agreeance with the prices, the product description at the time of sale and general conditions of sale, which will be the only applicable conditions upon completion of the contract.

You agree to use the website “www.funidelia.co.uk” solely for placing legally valid orders or inquiries. You are also obliged to correctly and truthfully disclose your email address, postal address and/or other contact details to us, while recognising that we may use this information to contact you if necessary (see: our Privacy Policy). If you do not provide us with all of the necessary information, we will not be able to process your order.

By placing an order at “www.funidelia.co.uk” you are confirming that you are fully authorised to use the credit card, in the case that you choose to use this payment method. Only those with the necessary juridical ability to sign contracts relative to the goods and services featured in this website can process orders on “www.funidelia.co.uk”

In order to place an order, follow the online purchase process until payment.

After that, you will receive an email acknowledging receipt of your order. Bear in mind that this does not mean that your order has been accepted, only that you have sent us a request to purchase one or more of our products. All of the orders are subject to our confirmation. We will confirm your order by sending you an email stating that the product(s) is/are being dispatched (Dispatch Confirmation).

The purchase contract between Funidelia and the customer is formalised only upon sending this Dispatch Confirmation.

Only the products included in the Dispatch Confirmation are applicable to the Contract.

We will not be obligated to provide any other product that may have been included in the order until we send you a Dispatch Confirmation of said product.

FUNIDELIA will do their utmost to please all customers regarding product demand. However, all orders are subject to product availability. If any provision difficulties arise or if the products are sold out, we reserve the right to suggest similar products of equal quality that are available. If you do not wish to order any of these suggested products, we will refund you for the unavailable products.

Delivery of Products

FUNIDELIA is commited to delivering their products in perfect condition to the delivery address indicated in the order form.

You may request that your order be delivered to a different address and to a different individual to that of the person placing the order, but only if the delivery address falls within our delivery area.

Deliveries will not be made to remote addresses or to locations outside of our delivery area. Funidelia therefore reserves the right to reject delivery to any areas that run a high risk of delivery failure.

With the aim of ensuring our delivery, we would appreciate if you could provide an address that is able to receive the delivery during working hours.

FUNIDELIA processes deliveries through renowned delivery companies, such as myHermes or DHL. We may incorporate new companies without notifying our customers.

FUNIDELIA will make all of the delivery details available to the customer. That is, the tracking number and company that will carry out their order, so that you can contact them directly regarding the current location of your order.

The delivery of merchandise will take place at the postal address indicated by the customer. In the event that the customer is absent upon delivery, a note will be left with instructions on how to arrange a new delivery, however we are unable to guarantee this. In most cases you will be contacted via e-mail. FUNIDELIA reserves the right to alter the delivery type and transport company, independent of what is covered here, as long as it does not suppose any damage or harm to the product.

The delivery costs will be indicated at the final stage of purchase and will depend on the chosen priority, urgent or normal, and the address location. The conditions are subject to change.

In accordance with the current Conditions, it is understood that the products have been delivered as soon as their reception has been signed for at the agreed delivery address.

Delivery Timeframe

Funidelia works with different delivery timeframes based on the product. You can consult the section on Deliveries, for the principles behind this. However, during the purchase process you will be able to check the progress of each order.

If any of the requested products are not currently in our warehouse, delivery may be delayed. You will be notified of this as soon as the purchase is made.

Some products on www.funidelia.co.uk have different delivery time frames than the usual, but this will be correctly outlined in each product’s page.

These time frames are averages, and therefore only estimates. It is possible that they may vary due to logistical or unforeseen reasons.

If for any reason we are unable to make the estimated delivery date, we will notify you and give you the option of continuing or not with the purchase. If you choose to continue, a new delivery date will be established. If you choose to cancel the order, you will be refunded with the full purchase amount. Bear in mind that we do not deliver on Sundays.

Failure to Deliver

Extraordinary circumstances may arise, such as a delay in stock, that impede the product’s delivery at the time of order confirmation. In these cases, you will be notified as to why the normal order process has been interrupted. You will be provided with a new delivery date, or full refund of the total purchase amount.

The prices listed on the website “www.funidelia.co.uk” include VAT, applicable from the day of the purchase, but exclude the delivery costs and possible administrative cost, which will added to the total amount.

FUNIDELIA reserves the right to change the sale prices listed on www.funidelia.co.uk at any moment. However, prices might be subject to error.

FUNIDELIA reserves the right to change the payment methods by creating new ones or eliminating existing ones, without the customer’s objection. However, if the change in payment method affects an order that has already taken place, “www.funidelia.co.uk” will contact the customer to notifiy them of this change and give them the option of cancelling.

Payment with Secure Visa Card or American Express

The charges are made online once the corresponded details are verified through the payment gateway of the relevant financial entity.

With the aim of providing maximum security to our payment system, “www.funidelia.co.uk” uses secure systems from leading financial entities in e-commerce.

This way, your confidential details are sent in an encrypted format (SSL) directly to the corresponding entity. The encryption system SSL that we use guarantees top security and confidentiality upon sending your details through the network.

Your credit card details are not stored in any of our databases. They are only used at the virtual POS (Point of Sale) of our financial entities’ secure payment gateway.

The credit cards will be subject to verification and authorisation from their issuing entity. If the relevant issuing entity cannot authorise the payment, we will not be responsible for any delay or delivery failure, and will not be able to formalise a contract with you.

FUNIDELIA reserves the right to verify the personal details submitted by the customer and to take the necessary measures (including cancelling the order) to ensure that the purchased merchandise is delivered in accordance with the details provided in the order.

FUNIDELIA offers guarantees in cases of faulty manufacture. Any defect or imperfection created by misuse of the product is not covered under this guarantee.

In case of a faulty product, Funidelia will carry out the relevant repairs, replacement, price discount or contract annulment, the costs of which will be free of charge for the customer. Funidelia will hold responsibility over faulty products for a period of two years from the date of delivery. The customer must inform Funidelia about any product faults within two months of discovering the fault.

The returned item must respect the aforementioned stipulations of the Return Policy.

The guarantee is not applicable to defects or deterioration caused by external factors, accidents, especially electrical accidents, wear and tear, misuse and disregard for the product’s instructions as stated by the Provider.

Products that have been modified or repaired by the customer or any person not authorised by the Provider are not covered by the guarantee.

The responsibility of FUNIDELIA regarding any product purchases on “www.funidelia.co.uk” will be strictly limited to the price of the product, and will not cover small errors or omissions that may take place when all the necessary precautions have been adhered to.

FUNIDELIA will not be held responsible for damages, whether they be material or immaterial,that may result from misuse of their products. This also applies to the possible changes made to the products by the supplier.

FUNIDELIA will not be held responsible for any indirect damages, operating loss or unemployment suffered by the customer or third party, even if said damage, loss or setback may have been foreseen by FUNIDELIA or have been placed in their knowledge.

Subject to the implications of the preceding paragraphs, the financial responsibility of FUNIDELIA according to the current general conditions cannot exceed that of the total amount paid upon purchase, regardless of the question at hand.

The stipulations set forth in this clause will not affect the consumer’s rights recognised by the law, nor their right to abandon the contract.

These general conditions are regulated by Spanish law. Both parties are free to consult the tribunals of Zaragoza in order to resolve conflicts or renounce any other jurisdiction.

The elements of this website are designed with the aim of offering the sale of products identified by FUNIDELIA.

All of the illustrations, designs, symbols, graphics, photographs, images and any other element that form part of the website are exclusive property of FUNIDELIA, or are licensed by the official supplier.

We inform our customers that the rights of FUNIDELIA as to the content, design and source code of this website are protected under current Spanish and International legislation regarding intellectual and industrial property.
